Terms & GDPR

The chair, the till, and your photo

These terms are the contract for hairous. The privacy notice in this page is how we meet the UK GDPR. They were last updated on 28 September 2026. If you do not agree, do not sit and do not pay.

hairous is a browser studio that draws hair and makeup onto a photo you choose. It is not a salon, not a hairdresser, and not advice about your face, skin, or health. A picture from the chair is a preview. It can miss. It is not a promise of how a real cut, colour, or makeup look will turn out.

Who we are

The service is run as hairous. For privacy, the controller is the operator of hairous. Write to commonbeingai@gmail.com. That address is also how you ask for your data rights. If a company name or postal address is later shown on the contact page, that name is the controller.

Who may use it

You must be 18 or older. Do not upload a photograph of anyone under 18, even with a parent’s permission. Do not upload a person who has not agreed to this edit, including a stranger, a client who only agreed to a different use, or a public figure you have no right to depict.

You are responsible for the photo, the reference pictures, and the instructions you send. If someone claims the photo, the likeness, or the way you used the result, you will deal with that claim and cover the loss we suffer because of it, except where the law does not allow that promise against a consumer.

What a sitting is

You pick a photo and the changes. When you start a sitting, that photo, the settings, and any reference picture you added are sent so the edit can be made. The finished picture is returned to this browser. We do not keep a gallery of customer photographs on our servers.

On your device, the chair may read facial landmarks so the wipe can line the result up with the original face. Those points stay in the browser for that sitting. They are not sent as an identity record, and they are not used to recognise you on a later visit. We do not build a face-recognition file, and we do not sell photographs.

By starting a sitting you explicitly agree that the photo, including the face in it, may be processed for that edit and for no other product of ours. You can refuse by not sitting. Stopping later does not pull back a picture that was already made, and it does not delete a picture that exists only in your browser. You delete that one yourself.

An ordinary sit costs 1 sitting and is standard. Five angles costs 3 sittings. Each frame of the five is standard. A sharper 2K pass on the picture in the pane is its own sitting, unless your plan includes it. If the front is already 2K, that front is kept as the middle of a five and is not made again. A 2K side is not used as that middle. The four sides are still standard.

What you must not do

Do not use the chair for a sexual or nude edit, for harassment, for a fraud, or to pass the result off as an untouched photograph of a real person. Do not try to break the till, scrape the catalogue, or probe the service. Do not upload a photo you have no right to use. We may refuse a photo, a prompt, or a sitting, and we do not have to explain a refusal made to keep the service inside the law or the model provider’s rules.

Sittings and plans

A new chair may start with a small number of sittings on the house. The counter shows the number in force. We may pause free sittings, cap them, or change the number. A gift, a comp, or the house chair can be withdrawn if it was a mistake, an abuse, or no longer offered.

Walk-in is a one-off pack for personal use. The sittings do not expire while the service is open. Booked is a personal monthly plan. Shop and Pro are monthly plans that include commercial use for client work and include the 2K pane upgrade. After you cancel a monthly plan, sittings already on the chair last 90 days and then expire. Cancelling does not erase a picture already in this browser.

The allowance lives in this browser, not in a bank and not as cash. It is not transferable and not redeemable for money except where these terms say we will refund. If you clear the site data, use a private window, or change device, the balance on the old browser can be gone. We often cannot see that balance, and we do not promise to rebuild it. Sign-in does not, by itself, copy the balance to another browser.

Sharing a finished look from the chair can put one sitting back, up to five in total on that browser. We may stop that reward if it is abused.

Codes

A code is typed on the card page, not in the chair. Unless the counter says the code repeats every month, it applies once, to the first payment that accepts it. A monthly code applies to Booked and Shop, not to every pack. Codes do not exchange for cash. We may refuse, limit, or retire a code, including after it is published, if it is misused or was published in error. Stripe’s page decides whether a code attaches to that checkout.

Paying, cancelling, refunds

Card payments, including Apple Pay and Google Pay where the device offers them, are taken by Stripe. We do not receive your full card number. Monthly and yearly plans renew until you cancel in Stripe. Yearly billing, where it is offered, is the monthly price for a year with the discount shown on the counter, taken as one charge. Prices and sitting counts on the counter are the ones in force when you pay. A change to the tiers does not shrink a pack you have already paid for.

The chair is digital content. By paying, you ask us to put the sittings on this chair immediately, and you acknowledge that you lose the 14-day right to change your mind once that supply has started. That does not remove a right the law keeps where the service is faulty.

A picture you simply do not like, if the chair returned one, is not a fault. The model can change a face, miss a request, or invent a detail. If you were charged and no sittings were added, or a sitting failed and the balance was not put back, write to us with the receipt and we will restore the sittings or refund that charge. If we close the service for good, write within 30 days with the receipt email. We will refund the unused part of a pack we can identify, using the receipt and any use we can fairly see.

Who owns the picture

You keep whatever rights you already had in the photo you brought. You give us a limited permission to host that photo for the moment of the edit, to send it to the model provider for that request, and to return the result. That permission ends when the request is finished, apart from the short safety copies described in the privacy notice.

As between you and us, you may use the finished picture: personal use on Walk-in and Booked, and commercial client work on Shop and Pro. We do not claim your likeness. We also do not promise that an AI picture is unique, or that copyright protects it. Do not assume you can stop someone else from using a similar picture the model might make.

The app, the catalogue, the wording, the layout, and the hairous name stay ours. You may not copy the service or hold it out as your own product.

If the edit is wrong

The chair is offered as it runs. A result can be distorted, unlike the reference, or unsuitable to show a client. Check the face, hair, and any text before you share or publish. We do not promise a particular likeness, a particular salon result, or that the service will be up at every moment.

How far our responsibility goes

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any duty the law says we cannot limit or exclude. If you are a consumer, you keep the rights that law gives you for digital content that is not of satisfactory quality.

Subject to that, we are not liable for a look that disappoints you, for a real-world hair or makeup decision you take because of a picture, for a balance lost from this browser, or for loss of profit, clients, or goodwill. Our total liability for a claim about a pack or a sitting is what you paid us for that pack. If you paid nothing, it is £50. We do not take responsibility for Stripe, the model provider, or a sign-in provider failing on their own side, beyond sending the request and handling the answer we actually receive.

Stopping

You may stop using the chair at any time and cancel a plan in Stripe. We may suspend the service, a code, a comp, or a sign-in if we reasonably believe these terms were broken, a payment is in dispute, or the law or a provider requires it. Where we can do it without adding to the harm, we will tell you.

Privacy notice

This notice covers the chair, the counter, sign-in, and the shop desk. We do not sell personal information, and we do not use your photo to train a model of our own.

What we hold

If you sign in with Google or X, we receive the name, email, and profile image that provider sends, and we keep a session so the browser stays signed in. You can use the chair without signing in.

The photo, reference images, and the text of the settings are processed to make the sitting. The picture you keep is stored in this browser. A new chair, a comp, or a paid checkout can store an email address, a sitting count, and whether that person has sat, so the operator can run the till. A completed card payment stores the receipt email, the pack, the amount, and that Stripe marked it paid. The shop’s own mailbox, if the operator connects it, can show recent messages sent to the shop. Card numbers stay with Stripe.

Photos and faces

The photo is used to make the edit you asked for. It is not used to identify you in the world, to score you, or to advertise to you. The model provider is xAI. On the terms xAI publishes for its API, customer inputs and outputs are not used to train its models unless the customer allows it, and requests may be kept for about 30 days for abuse checks and then deleted. That is the provider’s rule, and it can change. We do not turn on a setting that asks them to train on your photo.

The lawful bases are: contract, for the sitting, the account, and the pack you asked for; explicit consent, for processing a photograph that shows a face in order to make that sitting; legitimate interests, for securing the till, preventing abuse, and keeping a shop record that is not excessive; and legal obligation, where tax or accounting law tells us to keep a payment record. You may withdraw the photo consent by not starting another sitting. Withdrawal does not make a completed edit unlawful after the fact.

Who else sees it

xAI receives the photo and the edit request. Stripe receives the checkout, and the receipt email if you enter one. Google or X receives the sign-in if you choose them. The host of the published site and the database that holds sign-in and the till see the technical data needed to run those parts. A person who emails the shop is writing to the operator’s mailbox. We share information if the law requires it, or to defend a legal claim. We do not pass the photo to an advertiser.

How long

We do not file your photograph in an account. The live request is held long enough to make and return the picture. The model provider may then keep its own short safety copy, as above. Pictures you save remain in this browser until you delete them or clear the site. Sign-in data lasts while the account is used, and a short while after if we need it for a dispute. Till and tax records are kept for up to six years after the payment, which is the ordinary UK accounting period. Shop mail is kept in the connected mailbox under that mailbox’s own rules, and a copy on the desk until the operator hides it.

Outside the UK

xAI’s image service can process a request outside the UK, including in the United States. Stripe, Google, and X may do the same. Where the law requires a transfer tool, we rely on the provider’s UK transfer terms, an adequacy decision, or the International Data Transfer Agreement. The photo should be sent only because you started a sitting.

This browser

The chair stores the sitting balance, the skin you picked, and your saved pictures in this browser. Sign-in uses a session cookie, or a session token in the embedded preview. We do not use advertising cookies and we do not run a third-party analytics tracker for ads. Clearing the site data removes the local balance and the wall.

Your rights

If the UK GDPR applies to you, you may ask to see the personal data we hold, to correct it, to erase it, to restrict it, to receive a portable copy of what you gave us, and to object to processing based on legitimate interests. You may complain to the Information Commissioner’s Office at ico.org.uk. Write to commonbeingai@gmail.com. We may need to confirm it is you. We aim to answer within one month. We will refuse a request only where the law allows, for example a tax record we still have to keep, and we will say why.

We cannot see, and so cannot email back, a picture that lives only in your browser. Erasing that one is done on the device, by deleting the sitting or clearing the site data.

Changes

We may update these terms by posting the new text on this page with a new date. A change does not take away sittings you have already paid for, except where we must follow the law or a payment provider’s rule. If you keep using the chair after the date, the new terms apply to the next sitting.

Law

These terms are governed by the law of England and Wales. The courts of England and Wales hear disputes, except that if you are a consumer in the UK you may also sue in the courts of the part of the UK where you live. Nothing here removes a right that statute says cannot be removed.
